Data deletion

This page sets out how data held by Genaro (“we,” “us,” or “our”) may be deleted, including data associated with an Account created by signing in through Google or any other identity provider, what is deleted when an Account is erased, and for how long deleted data may persist. Capitalized terms not defined here have the meanings given in our Terms of Service. This page forms part of the Terms of Service and should be read with our Privacy Policy.

1. Deletion Available to You

1.1 Assets

You may delete an Asset at any time through the API. Deletion removes the Asset together with its thumbnails, previews and other derived versions. The records of the Asset are removed from your Account immediately, and removal of the stored files is initiated at the same time and performed by background processing, normally promptly. Deletion is permanent: there is no trash and no means of restoring a deleted Asset. If our storage provider is persistently unavailable, automatic removal of the stored files may be abandoned and the files may remain in storage although the Asset no longer appears in your Account; in that event, contact us at support@genaro.ai and we will complete the removal.

1.2 Derived Assets

Where an Asset has been derived from another Asset, deleting the source Asset deletes, by default, each Asset derived from it. You may instead elect to delete only the Asset you specify and leave its derived Assets in place, or elect to have the deletion refused, with nothing deleted, if the Asset has any derived Assets.

1.3 Other Resources

You may delete groups, agents, conversations, webhook destinations and telemetry destinations through the API, and API Keys through the console.

1.4 Records Not Deletable by You

Generation records, including prompts, parameters and usage records, and ledger entries cannot be deleted by you individually. They are deleted on erasure of your Account in accordance with Section 4, subject to Section 3.

2. Exhausted Balance and Account Lifecycle

2.1 Exhaustion of Balance

Exhaustion of your Balance does not by itself result in the deletion of any content. While your Balance is insufficient, new generation requests are declined until funds are added, and your content remains stored.

2.2 Past Due Accounts

We may designate an Account as past due. A past due Account is afforded a grace period of seven (7) days, during which its existing content remains accessible and new generation requests are declined.

2.3 Blocked Accounts

On expiry of the grace period, the Account is blocked for a period of thirty (30) days. While an Account is blocked, its API Keys cease to function in every Workspace, so that content cannot be retrieved through the API, but the Account holder may continue to sign in to the console and add funds.

2.4 Accounts Scheduled for Deletion

On expiry of that thirty (30) day period, the Account is designated as scheduled for deletion, which records that the Account’s content and stored files have become eligible for deletion. As of the date of this page, deletion of content on that basis is not performed automatically; content is deleted when you delete it, when you request erasure of your Account, or as otherwise provided in the Terms of Service. We will amend this page before we begin deleting content of Accounts on that basis.

2.5 Restoration

The addition of funds restores an Account to normal status from any of the foregoing states.

2.6 Notices

We may, but are not obliged to, notify the owners of an Account by email of a change in its status. You are responsible for monitoring the Balance and status of your Account.

3. Persistence of Deleted Data

  • Stored files: stored files are removed as soon as the removal process runs, normally immediately after deletion, and are not retained in any trash or archive, subject to Section 1.1.
  • Backups: our database backups may continue to contain deleted records for up to thirty-five (35) days, after which they expire.
  • Financial records: we retain ledger entries, usage totals and payment references for accounting, security and legal purposes for as long as applicable accounting and tax law requires, which may be up to seven (7) years. These records consist of amounts, dates and references and do not include your media or prompts.
  • Legal and safety preservation: we may retain content and records that we are required to preserve by law or lawful request, or that relate to suspected unlawful content or a violation of our Acceptable Use Policy, as described in that policy.

4. Erasure of Your Account

To request erasure of your Account and its data:

  1. Send an email to support@genaro.ai from the address with which you sign in, stating that you request erasure of your Account.
  2. We will reply to confirm the request. Because erasure is irreversible, we will not begin until you have confirmed.
  3. Within thirty (30) days of your confirmation, we will delete the Account’s Assets and stored files, generation records, conversations, destinations and API Keys, and your sign-in identity.
  4. We will retain only the data described in Section 3, and backups will expire as described in that section.

Deleting your sign-in through the account management feature of the console removes your sign-in but does not delete the content of your Account. To erase the content, follow the steps above. Any Balance remaining on an erased Account is treated in accordance with Section 5.5 of the Terms of Service.
