Acceptable Use Policy

This Acceptable Use Policy (“AUP”) sets forth the rules and guidelines for using Genaro (the “Service”) at https://genaro.ai, operated by Genaro (“we,” “us,” or “our”). This policy supplements our Terms of Service, and capitalized terms not defined here have the meanings given in the Terms of Service. By using the Service, you agree to comply with this policy in its entirety. Violations may result in content removal, suspension of your Account, or permanent termination.

1. Purpose

Genaro enables its users to store media and to generate images, video and other media using generative artificial intelligence models operated by third-party providers (“Providers”). Because this technology is powerful and can be misused, this policy exists to:

  • Protect our users, the Service and the broader community from harm;
  • Prevent illegal, unethical or abusive uses of generative technology;
  • Comply with applicable laws and regulations; and
  • Maintain trust with our users, Providers and partners.

2. Absolutely Prohibited Content — Zero Tolerance

The following content is strictly and unconditionally prohibited. These rules apply regardless of context, artistic intent, fictional framing, research purpose or any other claimed justification, and they apply equally to content you upload, content you request, and content generated for you. Violations result in immediate permanent termination of your Account, forfeiture of any Balance to the extent permitted by applicable law, removal of the content, and reporting to law enforcement and other authorities where applicable.

2.1 Child Sexual Abuse Material (CSAM)

Any sexually explicit, suggestive or exploitative content depicting or describing minors (any person under 18 years of age), whether real or artificially generated. This includes:

  • Photographic or realistic imagery of minors in sexual or sexualized situations;
  • Stylized, cartoon, illustrated, animated or anime depictions of minors in sexual or sexualized situations;
  • “Aged up” or otherwise relabeled depictions of characters or persons who are, or who appear to be, minors;
  • Any content that sexualizes youth, school settings, childlike features or other contexts associated with minors;
  • Uploading, as an input or reference, any image of a minor with the intent or effect of producing sexualized or exploitative output; and
  • Prompts, instructions or attempts, successful or not, that seek to elicit any of the foregoing, and any content facilitating the grooming, solicitation or exploitation of minors.

We are legally and morally obligated to report suspected CSAM to the National Center for Missing & Exploited Children (“NCMEC”) and to relevant law enforcement authorities, and we will do so.

2.2 Non-Consensual Intimate Imagery (NCII)

Intimate, sexual or nude imagery or video depicting real, identifiable persons without their explicit, documented, verifiable consent. This includes:

  • Deepfakes of real persons in sexual or intimate contexts;
  • “Face-swapping” or otherwise transposing a real person’s likeness onto sexual or intimate content;
  • “Undressing,” “nudifying” or similar alteration of an image of a real person so as to depict them nude or in a state of undress;
  • Revenge pornography and sextortion material, whether authentic or artificially generated; and
  • Any intimate imagery of a real person created, stored or distributed without that person’s consent, regardless of how it was produced.

Public figures, celebrities and influencers are real, identifiable persons for the purposes of this section. Content that sexualizes a real person is prohibited even where the person is deceased.

2.3 Terrorism and Violent Extremism

Content that:

  • Promotes, recruits for, finances or incites terrorism or violent extremist acts;
  • Glorifies or celebrates terrorist organizations, perpetrators or attacks, or provides instructional material for mass violence;
  • Depicts graphic real-world violence for the purpose of shock, intimidation or recruitment; or
  • Constitutes propaganda, symbols or branding of organizations designated as terrorist or violent extremist under applicable law, produced to promote them.

2.4 Sexual Violence and Exploitation

Content depicting sexual violence, coercion, trafficking or exploitation of any person, or facilitating human trafficking or the commercial sexual exploitation of any person.

2.5 Illegal Content

Any content that violates applicable federal, state, local or international law, including content that provides instructions for, or materially facilitates, the manufacture of weapons or explosives, chemical, biological, radiological or nuclear harm, or the trafficking of controlled substances. You are responsible for understanding the laws that apply in your jurisdiction.

3. Prohibited Activities

3.1 Fraud, Deception and Impersonation

  • Creating artificially generated content intended to impersonate real persons for deceptive purposes, including scams, phishing, social engineering or identity theft;
  • Generating fake documents, credentials, identification, certificates, financial instruments or evidence;
  • Creating synthetic media presented as an authentic recording, photograph or footage, without clear disclosure that it is artificially generated, in any context where authenticity is material;
  • Using a real person’s name, face, voice or likeness to endorse, solicit or defraud without their authorization; and
  • Using the Service to facilitate financial fraud or deceptive business practices.

3.2 Misinformation and Disinformation

  • Generating fake news articles, fabricated evidence or synthetic propaganda intended to mislead the public;
  • Creating artificially generated content designed to manipulate elections, political processes or public opinion through deception, including depictions of candidates, officials or voting procedures intended to mislead voters;
  • Producing fabricated testimonials, reviews, endorsements or other social proof;
  • Generating fabricated depictions of crises, disasters or public emergencies intended to deceive or cause panic; and
  • Generating content designed to erode trust in legitimate institutions through fabrication.

3.3 Harassment and Harm

  • Using the Service to harass, threaten, stalk, bully or intimidate any person;
  • Creating content intended to humiliate, degrade or cause emotional distress to specific individuals;
  • Doxing, or creating content that facilitates doxing;
  • Generating content that incites, encourages, instructs or glorifies self-harm, suicide or eating disorders; and
  • Generating gratuitously graphic depictions of violence or cruelty directed at identifiable persons or at animals.

3.4 Hate Speech and Discrimination

  • Generating content that promotes hatred, violence or discrimination against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability or other protected characteristics;
  • Creating content that dehumanizes, degrades or promotes stereotypes of any group; and
  • Producing propaganda for hate groups or extremist organizations.

3.5 Intellectual Property Infringement

  • Intentionally generating content that reproduces copyrighted works (photographs, artwork, characters, logos, trademarks) without authorization;
  • Using the Service to create counterfeit goods, knockoff merchandise or infringing derivative works;
  • Uploading as inputs or references material that you do not have the right to use; and
  • Generating content that violates the intellectual property, privacy or publicity rights of third parties with the intent to profit or deceive.

Note: Generated Content may unintentionally resemble existing works. You are responsible for reviewing your content and ensuring that it does not infringe the rights of others before publishing or distributing it.

3.6 Spam and Commercial Abuse

  • Generating bulk unsolicited content for spam campaigns;
  • Automated mass generation of content for search-engine manipulation, comment spam or social media flooding; and
  • Reselling, sublicensing or providing unauthorized third-party access to the Service, as further described in the Terms of Service.

4. Content Responsibility and Legal Compliance

You are solely and entirely responsible for all content you upload, request, generate, store or distribute through the Service. You must ensure that your content complies with all applicable laws in your jurisdiction and in every jurisdiction in which it is distributed or made available.

4.1 Content Requirements

  • All depicted persons and characters must be adults. Any person or character depicted in a mature or sensitive context must be clearly and unambiguously adult (18 or over). Where there is doubt, the content must be treated as prohibited.
  • No real persons without consent. Content depicting real, identifiable persons in sensitive, intimate or compromising contexts requires their explicit, documented consent. This includes public figures, celebrities and influencers.
  • No illegal acts. Content must not depict acts that are illegal under applicable law.
  • Provider compliance. You must comply with the content policies and usage terms of the Provider whose model processes your request, including any restrictions on the use of output. Some Providers restrict content more narrowly than this policy; violating a Provider’s policy may result in the Provider terminating our access or yours, and does not relieve you of your obligations under this policy. If a Provider restricts a content type, you must respect that restriction regardless of what this policy permits.
  • Jurisdictional compliance. Laws regarding generative artificial intelligence, synthetic media, obscenity, personality and publicity rights, and digital media vary significantly worldwide. You are solely responsible for understanding and complying with the laws that apply to you and to your end users. We do not provide legal advice, and the fact that the Service performs a request is not a representation that the content is lawful anywhere.

4.2 Content You Publish or Distribute

You bear full responsibility for how you publish, distribute, display or otherwise make available content created or stored through the Service, whether directly or through a product or service you operate. This includes compliance with the rules of any platform on which you post the content, age-verification requirements, content-labeling and synthetic-media disclosure obligations, advertising and consumer-protection rules, and any other applicable regulation.

5. AI Generation Rules

When using generation features of the Service, you agree to:

  • No prohibited content generation. Not request or attempt to generate any content that falls within Section 2 or Section 3, whether or not the attempt succeeds. An attempt is a violation of this policy.
  • No filter circumvention. Not attempt to circumvent, bypass, probe or trick content safety filters, moderation systems, limits or other safety measures, whether ours or a Provider’s, including by rephrasing, obfuscating or splitting a request, by using coded language or by using one input to defeat a control applied to another.
  • Disclosure of synthetic content. When publishing artificially generated content externally, not present it as authentic photography, real footage or non-artificial content in contexts where the distinction matters, including news, evidence and testimony, and comply with any law requiring synthetic content to be labeled.
  • Review before publishing. Review Generated Content before publishing or distributing it, as generation may produce unintended artifacts, biases or inappropriate output.
  • Accept limitations. Understand that generation is imperfect, may produce unexpected results, and may occasionally produce content that does not match your intent or that falls within a prohibited category. You must not distribute, and must delete, any such content.

6. API Keys and Account Responsibilities

  • Use API Keys only in connection with your own Account and keep them confidential; do not publish them, embed them in publicly accessible code, or share them with persons you have not authorized;
  • You are responsible for all content generated and all charges incurred through your API Keys, and for the conduct of anyone to whom you give access;
  • Do not use stolen, unauthorized or fraudulently obtained payment methods, credentials or API Keys;
  • Do not create multiple Accounts to circumvent restrictions, suspensions, limits or billing;
  • Do not attempt to access other customers’ Accounts, Workspaces, data or generated content, or to circumvent the boundaries between Workspaces;
  • Do not abuse the Service infrastructure through automated scraping, denial-of-service attacks or intentional excessive load;
  • Do not attempt to reverse-engineer, decompile or extract the source code of the Service; and
  • Do not exploit bugs, vulnerabilities or errors in the Service; report them to support@genaro.ai instead.

7. Reporting Violations

If you encounter content or conduct that you believe violates this policy, please report it to support@genaro.ai. Include as much detail as possible:

  • A description of the violation;
  • Any relevant identifiers, links or screenshots; and
  • The specific section of this policy that you believe was violated.

Complaints of intellectual property infringement should identify the work claimed to be infringed, the material complained of, and the complainant’s contact details and authority to act. We take all reports seriously and will investigate promptly. We will not retaliate against any person who reports a violation in good faith.

8. Enforcement

Violations of this policy may result in one or more of the following actions, at our sole discretion and without prior notice where we consider it necessary:

8.1 Warning, Refusal and Content Removal

For minor or first-time violations, we may refuse the request, issue a warning and remove the offending content. You will be notified of the violation and the corrective action expected.

8.2 Suspension

For repeated or moderate violations, or while we investigate a suspected violation, we may suspend or block your Account for a period determined by the severity of the violation. While an Account is blocked, its API Keys cease to function in every Workspace and no new generation requests are run. Content may be deleted by you as described on the Data Deletion page, except where we are required or entitled to preserve it.

8.3 Permanent Termination

For severe or repeated violations, we will permanently terminate your Account. Any Balance may be forfeited to the extent permitted by applicable law, as provided in the Terms of Service. You may not create a new Account.

8.4 Law Enforcement Reporting and Preservation

For violations involving illegal activity, including CSAM, NCII, fraud and terrorism, we will report the violation to NCMEC and to relevant law enforcement authorities and cooperate with their investigations. We may preserve content, Account records, generation records and related data, including after deletion by you, where we are required to do so or where we reasonably believe preservation is necessary to protect any person, and we may be legally required to produce that data in response to lawful requests. Our Privacy Policy describes how we handle personal data in these circumstances.

8.5 Immediate Termination Triggers

The following violations result in immediate permanent termination without warning:

  • Any CSAM, or any attempt to generate it;
  • Non-consensual intimate imagery of real persons;
  • Content promoting terrorism, violent extremism or mass violence;
  • Fraud, phishing or identity theft;
  • Use of stolen or unauthorized payment methods, credentials or API Keys; and
  • Deliberate and repeated circumvention of content safety filters or moderation systems.

8.6 Review

If you believe an enforcement action was taken in error, you may write to support@genaro.ai and we will consider your request. We are not obliged to reverse an action, and we may decline to review actions taken under Section 2 or required by law.

9. Changes to This Policy

We may update this Acceptable Use Policy from time to time to address new risks, reflect changes in law, or adapt to evolving generative capabilities. We will notify you of significant changes by posting the updated policy on this page with a new “Last updated” date and, for material changes that affect what content is permitted, by notifying the owner of your Account by email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated policy.
